Mark-It™ Signals Terms of Service

1. Acceptance of Terms

By accessing or using Mark-It™ Signals ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Nature of the Platform

Mark-It™ is a neutral technology platform that enables users to submit location-based observations ("Marks") about physical properties. The Platform:

• Does NOT verify the accuracy of user submissions
• Does NOT investigate claims or determine fault
• Does NOT endorse, approve, or take responsibility for user content
• Operates solely as a communication conduit between users and property operators

All Marks are unverified user-generated observations and should be treated as informational signals only.

3. User Representations

By submitting a Mark, you represent and warrant that:

• You are physically present on the property at the time of submission
• Your submission is based on your genuine observation
• You will not make false, defamatory, or malicious submissions
• You will not use the Platform to harass, threaten, or harm others
• You own or have rights to any photos or audio you submit

4. Acceptable Use Policy

You may NOT use the Platform to:

• Make explicit accusations of criminal conduct
• Post threats, harassment, or private personal information
• Submit content that violates copyright or intellectual property rights
• Use profanity, hate speech, or discriminatory language
• Submit spam, advertising, or promotional content
• Attempt to circumvent geofencing or location verification

Violations may result in removal of content and suspension of access.

5. Content License and Rights

By submitting content, you grant Mark-It™ Signals a non-exclusive, worldwide license to host, display, and transmit your content for the purpose of operating the Platform. You retain ownership of your content but acknowledge it may be shared with property operators.

6. Privacy and Data Collection

Your use of the Platform is subject to our Privacy Policy, which describes our collection and use of location data, device identifiers, and submitted content.

7. AI-Generated Summaries

The Platform may use artificial intelligence to group, summarize, or analyze user submissions. All AI-generated content is unverified and may contain errors. Mark-It™ makes no representations about the accuracy of AI summaries.

8. Business User Acknowledgments

Property operators and business users acknowledge that:

• Marks are user-generated and not verified by Mark-It™
• The Platform does not conduct investigations or determine validity
• Marks should be evaluated independently by the business
• Mark-It™ is not liable for user-submitted content

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. MARK-IT™ SIGNALS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

MARK-IT™ SIGNALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR USER-GENERATED CONTENT.

11. Binding Arbitration and Class Action Waiver

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

You have the right to opt out of arbitration by sending written notice within 30 days of first using the Platform to: legal@markitsignals.com

12. Modifications

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will require re-acceptance before submitting new Marks.
